Terms and Conditions (Grind Cards)
Article 1 – Definitions
In these terms:

Cooling-off period: the period within which the consumer can exercise the right of withdrawal.

Consumer: a natural person not acting for purposes relating to trade, business, craft, or profession.

Day: calendar day.
-
Duration contract: a contract for the regular supply of products/services over a period.
-
Durable medium: any tool that enables the consumer or entrepreneur to store information for future reference (e.g., email, PDF).
-
Right of withdrawal: the consumer’s option to dissolve the distance contract within the cooling-off period.
-
Model withdrawal form: the form provided by the entrepreneur for exercising the right of withdrawal.
-
Distance contract: an agreement concluded within an organised system for distance selling without simultaneous physical presence of parties.

Distance communication: means used to conclude a contract without physical presence (e.g., web, email).

Entrepreneur: Grind Cards (the seller).

Terms: these Terms and Conditions.

Article 3 – Applicability

These Terms apply to every offer by Grind Cards and every distance contract concluded with a consumer.

Before conclusion, the Terms are made available to the consumer. For online contracts, they can be stored on a durable medium.

If specific product terms apply in addition to these Terms, the most consumer-favourable provision prevails in case of conflict.
-
If any provision is void/voided, the remaining Terms remain effective; the invalid clause is replaced with one closest in purpose.
-
Situations not covered or ambiguities are interpreted in the spirit of these Terms.
Article 4 – The offer

If an offer is valid for a limited time or subject to conditions, this is stated.

The offer is non-binding; Grind Cards may adjust it.
-
Product descriptions are complete and accurate; images are a truthful representation. Obvious mistakes do not bind Grind Cards.

Each offer states, where relevant:

Price incl. VAT;
-
Shipping costs;
-
How the contract is concluded and necessary steps;
-
Whether the right of withdrawal applies;
-
Payment, delivery, and performance methods;
-
Acceptance period/price guarantee period;
-
Whether the contract is archived and how to access it;
-
How to check and correct input before ordering;
-
Available languages;
-
Codes of conduct (if any) and how to consult them;
-
Minimum duration in case of duration contracts.

Article 5 – The agreement

The contract is concluded when the consumer accepts the offer and meets the stated conditions.

If accepted electronically, Grind Cards promptly confirms receipt electronically. Until confirmed, the consumer may dissolve.
-
Grind Cards uses appropriate technical and organisational measures to secure electronic data and payments.
-
Grind Cards may lawfully assess the consumer’s ability to meet payment obligations. If there are legitimate reasons, an order may be refused or special conditions applied.

Upon delivery, Grind Cards provides, on a durable medium:

Complaint address;
-
Conditions and method for exercising withdrawal (or exclusion thereof);
-
Warranty information and after-sales service;
-
The information of Article 4(4), unless already provided;
-
Termination requirements for duration contracts.

Each contract is subject to availability of the products.
Article 6 – Right of withdrawal (Consumers)
Products
-
The consumer may dissolve the contract within 14 days after the day the consumer (or a designated third party) received the product.
-
During the cooling-off period, the consumer shall handle the product and packaging with care and only unpack/use it as necessary to establish the nature, characteristics and functioning.
-
To exercise the right, the consumer notifies Grind Cards within 14 days of receipt (email is sufficient). The consumer then returns the product within 14 days of this notice.
-
The consumer bears the direct cost and risk of return shipment unless otherwise agreed.
-
Returns are only accepted if the item is sealed, unopened, and in original condition. Sealed TCG products (booster boxes/packs, ETBs, bundles) are not returnable if the seal is broken.

The consumer’s legal rights remain unaffected for defective products.
Services (if applicable)
7. For services, the consumer may withdraw within 14 days after conclusion unless the service has been fully performed with prior express consent and acknowledgment of waiver.
Article 7 – Costs and refunds in case of withdrawal

If the consumer has paid amounts, Grind Cards refunds without undue delay and within 14 days after being informed of withdrawal. Grind Cards may withhold refund until receipt/inspection or proof of return.

Refunds use the same payment method unless otherwise agreed.
-
If a product is diminished in value due to handling beyond what is necessary to establish its nature/characteristics/functioning, the consumer is liable for any depreciation.
Article 8 – Exclusions from withdrawal (Consumers)
Withdrawal is excluded for:
-
Products made to the consumer’s specifications or clearly personalised;
-
Sealed goods which are not suitable for return due to health protection or hygiene and which were unsealed after delivery;
-
Goods which by their nature are sealed collectibles where opening the seal irreversibly affects market value (e.g., TCG booster packs/boxes/ETBs/bundles once unsealed);
-
Goods liable to deteriorate or expire rapidly;
-
Newspapers/magazines (single issues);
-
Audio/video/software with broken seals;
-
Services for accommodation/transport/catering/leisure with a specific date;
-
Services commenced with express consent before the end of the cooling-off period.
Article 9 – Price
-
Prices shown during the validity period will not be increased, except VAT changes.
-
Products subject to financial-market fluctuations may be offered at variable prices; this will be stated.
-
Price increases within 3 months after conclusion only if due to legal provisions. After 3 months: only if stipulated and the consumer can terminate as of the date the increase takes effect.

All prices are incl. VAT.
-
Obvious typographical/pricing errors do not bind Grind Cards.
Article 10 – Conformity and warranty

Grind Cards guarantees that products comply with the contract, stated specifications, reasonable usability/reliability, and applicable legal requirements at the time of conclusion.

Any statutory warranty rights remain unaffected.
-
Defects or incorrect deliveries must be reported within 2 months of discovery. Products must be returned in original packaging where reasonably possible.
-
Warranty is void if the consumer (or third party) repairs/alters the product, or if it was used abnormally/contrary to instructions.
-
Random contents of sealed TCG products are not guaranteed.
Article 11 – Delivery and performance

Delivery takes place at the address provided by the consumer.
-
Orders are processed with due care and shipped within 30 days unless a longer period is agreed.
-
In case of delay, the consumer will be informed. The consumer may dissolve without cost if delivery cannot occur within 30 days and no alternative is agreed.
-
Delivery times are indicative; exceeding them does not entitle to damages.
-
If delivery is impossible, Grind Cards may offer a replacement; this will be clearly stated. Right of withdrawal cannot be excluded for replacements. Return costs for replacements are for Grind Cards.

Risk of loss/damage passes upon delivery to the consumer or a designated recipient.
Article 12 – Duration contracts: termination and renewal

The consumer may terminate an indefinite contract for regular delivery with one month’s notice.
-
A fixed-term contract may be terminated at the end of the term with up to one month’s notice.
-
Renewal rules follow Dutch law: no tacit renewal for fixed-term contracts beyond what the law permits; indefinite renewal must allow termination at any time with one month’s notice.
Article 13 – Payment

Unless otherwise agreed, amounts due should be paid at checkout. Post-payment (e.g., Klarna/Riverty) is available where offered and subject to their terms.

The consumer must report inaccuracies in provided payment details immediately.
-
In case of non-payment, lawful (pre-disclosed) collection costs may be charged.
Article 14 – Complaints procedure

Grind Cards has a transparent complaints process.
-
Complaints about performance of the contract must be submitted clearly and fully within a reasonable time (preferably within 2 months after discovery) to info@grindcards.com.

Grind Cards responds within 14 days. If longer is needed, you’ll receive an acknowledgment with an expected timeframe.
-
If a complaint cannot be resolved amicably, a dispute arises as per Article 15.
-
A complaint does not suspend payment obligations unless Grind Cards confirms otherwise in writing.
Article 15 – Disputes

Only Dutch law applies to these Terms and contracts with consumers, even if the consumer resides abroad.
-
The CISG (Vienna Sales Convention) does not apply.
-
Courts in the Netherlands have jurisdiction, without prejudice to mandatory consumer venue rights.
Article 16 – Additional or different provisions
Any additional or deviating provisions will not disadvantage the consumer and will be recorded in writing or storable on a durable medium.
Pre-orders (Consumers vs B2B)

Consumers: Pre-orders ship on/shortly after release once stock arrives. Orders with multiple items ship when all items are in stock (unless split shipping is agreed). Consumer statutory rights (including withdrawal after receipt) remain. Release dates may change per publisher (Pokémon/Bandai).
